RIDDOR changes on track for April

The government has published the Reporting of Injuries, Diseases and Dangerous Occurrences (Amendment) Regulations 2012

The Regulations, which will come into force on 6 April subject to parliamentary consent, will raise the absence period that triggers an accident report to the HSE or local authority under RIDDOR from three to seven days.

Regulation 3(2) has been amended to state that employers only have to report injuries that lead to an absence from normal duties of over seven days.

The deadline after the injury by which dutyholders have to notify the authority will be extended from 10 to 15 days.

Regulation 7 of RIDDOR has been changed to make clear that through the threshold for notifiable injuries has been extended, employers still have a duty to record all other-three-day injuries, keeping details of the name and occupation of the injured person, the date and place of the incident and a short description of what happened.

The Regulations also amend the Safety Representatives and Safety Committees Regulations to make it clear that the change does not affect the duty of employers to allow union representatives to inspect the part of a site where an incident resulting in an over-three-day injury took place. There will be a similar amendment to the Offshore Installations (Safety Representatives and Safety Committees) Regulations
